Interpreting the Qur'an

Recently Darul Ulum, Deoband issued a fatwa saying that if a woman works in any government or public office with other men, the income will be haram (prohibited) for her family. This fatwa was published prominently in a leading newspaper. This stirred a hornets’ nest and a large number of Muslim women and men, including some Ulama opposed the fatwa and Darul Ulum had to say it never issued such fatwa and that it had only responded to a question about women working in public offices.
Most of the Ulama who defended the fatwa argue that women can work in what they keep on calling shar’i hudud (limits of shari’ah). Firstly question arises why apply these shar’i hudud only to women? And secondly who will define these limits? For these ulama any mixing of men and women is an act of fitna (mischief). For them a woman’s character and integrity has no meaning or significance at all. If she raises the veil from her face in a mixed gathering, she is responsible for causing fitna.
There are several instances in the Holy Prophet’s life when men and women came together and Hazrat A’isha even led the battle of Jamal (Camel) and there were hundreds of sahaba (companions) were around and no one told her not to venture out of home to take part in the battle. Shifa bint-e-Abdullah, a leading lady, was appointed by Hazrat Umar as market inspector and no one protested. What was she doing as a market inspector? Dealing with women alone?
The Qur’an, which is the primary source of shari’ah, does not refer to hijab (veil) for ordinary women at all. On the other hand, it advises women not to display her zeenah (adornments) publicly (24:31) but refrains from defining what constitutes zeenah or adornment. It has been defined by various commentators depending on their cultural environment. Qur’an does not even say whether women should cover their heads, let alone faces. It says, on the other hand “except what appears thereof” leaving space for interpretation. There is near agreement among commentators that face and two hands should remain open.
However, it advises women to cover their breasts.
This above verse is preceded by advice to both men and women that let believing men that they lower their gaze and restrain their sexual passions (protect their sexual organs) and let believing women lower their gaze and protect their sexual organs (24:30).
In fact this is most important part of these two verses. The verse 30 is often ignored in which a man is equally responsible for lowering his gaze and restraining his sexual passion.
Instead entire responsibility is put on women that they should cover themselves including their faces lest they should become source of fitna (mischief). Qur’an has put this responsibility on both men and women to restrain themselves. It is unfortunate that when it comes to women we totally ignore even what can be called maqasid al-shari’ah (ie intentions of shari’ah) and only the woman is held responsible for her behaviour.
Throughout the Qur’an men and women have been described as equally responsible for their deeds (a’mal) and will be given equal reward or punishment for whatever they do. If one needs any clarity on this let him carefully study the verse 33:35, besides several other verses in the Qur’an. If men and women are equally responsible for all their deeds both men and women will be equally responsible for their sexual conduct also and men would equally be source of fitna, not women alone as in our fiqh today.
In fact what our ulama call shar’i hudud were fixed by men who considered women as secondary to men and unequal in status due to cultural attitude towards women in the medieval era. The whole fiqh has to be thoroughly revised in keeping with the true spirit of Qur’an. Also, one needs to develop proper methodology and framework to understand Qur’anic intentions in totality, not in pieces, as our commentators have been doing.
Sticking to medievally understood shar’i hudud and culturally defined one, instead of religiously defined, will not serve the purpose any more to avoid such fatwas in future.

26/11 court’s observation on Karkare’s death buried by media

Mumbai: Maybe you don’t know it because most of the media highlighted only the death sentence of 26/11 accused Kasab, pronounced by the special anti-terror court of Judge M L Tahaliyani on May 6. While convicting Kasab the judge had questioned Mumbai Police on failure of ballistics experts in proving whose bullets killed Karkare, but media trashed it.
Judge Tahaliyani pronounced capital punishment for the 22-year-old Pakistani terrorist Ajmal Amir Kasab on four counts of murder, conspiracy to murder, waging war against the country and committing terrorist activities under the Unlawful Activities Prevention Act. 166 people were killed in the carnage on November 11, 2008. While convicting Kasab Tahaliyani had questioned the Mumbai Police about the ballistics experts having failed to prove whose bullets killed ATS Chief Hemant Karkare. The court asked why ballistic experts could not clarify the most crucial dimension of these killings. “Tahaliyani also criticised Constable Jadhav, the sole eyewitness and survivor of the killings of Karkare, Kamte and Salaskar, for changing his statement a few times. Although the testimony of the accused, in this case Ajmal Kasab, can never be taken seriously, but he called Jadhav a "liar" and claimed that his version of what happened at Cama Hospital, where all the three Mumbai Police officers were killed, was wrong. Interestingly, Kasab's cross-examination on the happenings around Cama Hospital and its periphery was conducted in camera,” says Hard News magazine in its latest editorial on the subject.
The questioning has again revived the conspiracy theories about the motive behind the killing of Karkare. If he was not killed by Pakistani terrorists Kasab or Ismail, then whose guns killed him?
Then ATS chief Karkare had exposed the involvement of Hindutva terror in the Malegaon blasts in 2008. He was threatened with death via anonymous phone calls because he was unearthing the network of Hindutva terror groups that were involved in similar incidents of blasts and killings all over the country. Of late, Karkare’s lead is helping in exposing the ugly face of Hindutva terrorism in the country. Recently they have been found involved in Ajmer Dargah and Makkah Masjid blasts.
Not only that ballistics experts failed to prove whose bullets killed ATS Chief Hemant Karkare, what has further strengthened the conspiracy theory is the disappearance of his bullet-proof jacket and the initial reluctance of the police to give his autopsy report. It was the tireless efforts of Karkare's wife, Kavita, and Kamte's wife, Vinita, that the report came into public.
The post-mortem report stated that Karkare received a total of five wounds on the shoulder blade, top region between neck and right shoulder, four entry wounds in one line. The report revealed that Karkare received one bullet in the neck and the other four were in a line entering the shoulder and exiting from the armpit.
“There were reports about two bullets being found in his body during autopsy. What happened to those two bullets? Whatever happened to the bullets that passed through his body? Were they found in the vehicle, in his bullet-proof jacket, around his body, or somewhere else? Has the gun been identified, the gun(s) which killed Karkare and others? If not, why? If he was shot at close range, was the shot fired from inside the vehicle, and if so, who fired it and why?” asked the Hard News.
According to specifications laid down for bullet-proof vests, the body should be covered from the neck till the waist. But the jacket worn by Karkare had only his chest covered while the neck portion was open.

Jerusalem In an unusual step, Israel, which is facing global criticism for attacking an aid flotilla, has said violent incidents in countries like India and Pakistan in the past one month which claimed 500 lives have been "ignored" while it is being condemned for its "unmistakably defensive actions".


Israeli Foreign Minister Avigdor Lieberman "reminded" the UN Secretary General Ban Ki-moon that in the past month alone 500 people were killed in various incidents in Thailand, Afghanistan, Pakistan, Iraq and India, a Foreign Ministry statement said.

"While the international community remained silent and passive, and generally ignored the occurences, Israel is being condemned for unmistakably defensive actions," a Foreign Ministry statement quoted Lieberman as saying.

This is the first time that Israel has dragged India into a controversy. New Delhi has already condemned the Israeli attack on the aid flotilla to the Gaza Strip saying there was no justification for indiscriminate use of force.

He is understood to have told Ban that the incident related to Gaza aid flotilla was about the "basic right of Israeli soldiers to defend themselves against an attack by a gang of thugs and terror supporters who had prepared clubs, metal crowbars and knives in advance of confrontation."

Lieberman expressed "regret" at the behaviour of the international community.

"All of Israel's proposals to the Turkish government to transfer the humanitarian aid in an orderly manner were rejected by flottila's organisers," Lieberman was quoted as saying.

He also accused activists participating in the mission of intentionally trying to breach Israel's sovereignty and creating "provocation that would cause bloodshed".

In an emergency session yesterday, the UN Security Council called for an investigation into Israel's deadly commando raid on ships taking humanitarian aid to the Gaza Strip on Monday, condemning the act that resulted in the loss of at least nine lives.

"... the Security Council resolution is unacceptable and contributes nothing to the promotion of peace and stability in the Middle East," Lieberman said.

India has quite rightly joined in the international condemnation of Israel’s attack on a flotilla of humanitarian aid ships on their way to the Palestinian enclave of Gaza. At least 10 people have been killed and it is feared that the death toll will be higher. The convoy was attempting to break an embargo placed on Gaza by Tel Aviv and was carrying 10,000 tonnes of supplies. Israeli commandoes rappelled down into the ships from helicopters and allegedly opened fire on the aid workers and activists on the ships.
Lately, India and Israel have moved closer together but this did not prevent the ministry of external affairs using stronger language than it has for decades. The statement read, “There can be no justification for such indiscriminate use of force, which we condemn. We extend our sympathies to the families of the dead and wounded. It is our firm conviction that lasting peace and security in the region can be achieved only through peaceful dialogue and not through use of force.”
Israel, however, seems set upon its course of using force to deal with the issue of Palestine. Its intransigence has led to it losing international support over the years. The United Nations is planning an emergency session of the Security Council to discuss the matter.
Israel stands practically isolated with regard to its Palestine policies and it now seems to depend solely on the United States to support it. The US is in the unenviable position of having to defend two of its oldest allies from the consequences of their own behaviour — the world no longer looks upon Israel and Pakistan with as much tolerance as it once did. The convoy which was largely Turkish, also included Americans, Palestinians and Europeans.
It seems that the amount of time that it has taken to deal with what is euphemistically called the “Middle east crisis” has only been detrimental to its solution. Positions have hardened over the years on both sides and violence — niggling attacks by Palestinians answered by resounding thumps by Israeli forces — has become the norm. Both sides have fallen prey politically to the radical rightwing and prospects of peace have moved away even further.
Sadly, as long as Israel behaves as if it does not belong to the comity of nations and will not therefore abide by accepted international norms, questions about its existence will become more strident. Having taken the law into its own hands with utter disregard for human life, Israel stands once more at the brink.

Strange are the ways by which the State of Israel shows its sovereignty. On Monday, as part of its policy of enforcing an economic blockade of Gaza, Israeli Defence Force (IDF) troops stormed a flotilla of civilian aid ships, killing at least ten passengers and injuring many more. These ships carrying passengers that included lawmakers, writers and journalists were planning to bring humanitarian aid to the people of Gaza who have been facing severe food and medical shortages. So even if the plan was to ‘break’ the blockade, an escorted non-entry move on the part of the IDF — rather than a full-scale commando operation — should have done the needful.
International opprobrium has ensued after the attack. But Tel Aviv has, in the past, proved its machismo to itself by shrugging off such criticism; it will do so again. Coming as this attack does a day before Israeli Prime Minister Benjamin Netanyahu was to meet US President Barack Obama in Washington, Mr Netanyahu has an additional agenda, the same that he showcased when giving the go-ahead to building Israeli settlements in East Jerusalem when US Vice President Joe Biden made his trip to Israel earlier this year: to drive home the message to Washington, and thereby to the world at large, that Israel can do whatever it likes, all in the name of its sovereign right to protect itself. But what is even more astounding is the realpolitik-diplomatic disaster that Mr Netanyahu’s unleashed in his dealings with Israel’s one open ally from the Muslim world, Turkey, in Monday’s attack. The flotilla under attack was sponsored by Turkey, the bulk of fatalities being Turkish passengers. It’s well nigh impossible that the IDF was unaware of this fact. If the increasingly Islamicist Turkish government ever needed an excuse to break the alliance with Israel, it certainly has been provided one.
Since the Palestinian group Hamas won the elections in the Gaza area in south-western Israel in 2006, defeating its Fatah rivals and taking over the administration of the area the following year, Israel (and Fatah-backing Egypt) reimposed an economic blockade on Gaza that was on and off in place since 2000. The blockade’s been an unsubtle attempt to wean support away from Hamas, and yet the results have been quite the opposite. If the actions and policies of Mr Netanyahu are to be explained by his desire to ‘neutralise’ an increasingly belligerent Iran, for which he does find support among the international community, Monday’s operation has certainly swung the pendulum against Israel’s favour. All one can smell is overreach, overkill and a deepening complex in Israel’s dealings with the world in which it has no qualms leaving even its traditional allies in a sticky, embarrassingly difficult situation.

Life hadn’t been this calm in the Middle East since the Iraq war. Yet, people have perhaps never been so pessimistic. Calm — despite the Iranian nuclear programme, the lack of a Palestine settlement, an impending transition in Egypt, Dubai possibly on the brink, the Islamist threat to Yemen, and a still unsettled Iraq. But it’s Israelis and Palestinians despairing the most. Nevertheless, the “proximity talks” appeared to have been salvaged from the controversy surrounding new constructions in East Jerusalem settlements announced at the start of US Vice President Joe Biden’s March visit, that brought US-Israel relations to a dramatic and historic low. Then, the Israel Defence Forces were authorised to rappel down to the Turkish-led flotilla reportedly carrying humanitarian aid to Gaza. The aftermath: 10 civilian activists killed by the IDF in international waters, people aboard the flotilla detained at the Israeli port of Ashdod, and a very isolated Israel facing near-unanimous global condemnation, offering defences few would buy.
Israel’s blinkered intransigence of late — whether West Bank constructions or the present government’s long refusal to acknowledge the two-state roadmap, or the policy leverage of right-wing fringe parties — is doing Israel as much disservice as did the 2006 Lebanon war. Israel recently turned away all-purpose dissenter Noam Chomsky; it’s blockaded Gaza for three years hoping to topple Hamas; and now it’s shot civilian activists. What has it achieved thereby? Israel is about to lose an old ally in the Islamic world, Turkey. Another Islamic ally, Egypt, will find itself at odds with a livid public. Israel has embarrassed an US trying to resuscitate the proximity talks. It’s also ensured that the global focus shifts from its own biggest concern — Iran — to itself. The UNSC, set to discuss fresh sanctions against Iran, now had to convene over the IDF assault.
Israel’s increasing tendency to shoot itself in the foot will not help its security. Its diplomatic standing is sinking. Little wonder that some have begun wondering if Israel’s agenda has moved from “self-defence” to “defence of the Gaza blockade”. Of all possible options, Israel chose the worst vis-a-vis the flotilla. And the one party that’s gained the most from the Gaza siege is militant Hamas, which has practically legitimised its narrative in many quarters. Meanwhile, ordinary Gazans suffer and Gilad Shalit languishes in captivity.

In attacking in international waters the Free Gaza peace flotilla made up of ships from Turkey, Europe and the United States, Israel has consolidated its reputation for disregarding international law and opinion. As the UN Security Council sought an independent inquiry into the shocking episode in which a large number of international peace activists may have been killed and many times that number injured, UN Secretary-General Ban Ki-moon strongly hinted that the raid on the flotilla by Israeli commandos in international waters may have placed Israel afoul of international law. Many believe that Tel Aviv has made a career of doing just this. Daniel Levy, a former Israeli peace negotiator who now researches at an American think tank, noted wryly after this predawn incident on Monday: “Israel constantly claims it wants the world to focus on Iran, but then it ends up doing something that gets everyone to focus on itself.”


For some time now, domestic politics in Israel and the ascendance in it of anti-Palestinian hawks has ensured that the US-inspired “roadmap” to peace has virtually run aground. Following the worldwide condemnation and anxiety caused by the peace flotilla incident in the Mediterranean, it is not unlikely that the Israeli ruling class’ aggressive posture will be further strengthened, marginalising even more the prospects of resumption of the long-stalled peace talks with Palestinians. Many are also likely to wonder if one of the reasons for the wholly illogical Israeli military response to ships carrying humanitarian assistance was not to scupper prospects of peace talks for a long time to come, unless they are held entirely on Israeli terms. The unexpected turn of events may be expected to upset several geopolitical calculations and inflame the Islamic world.

US President Barack Obama is likely to be placed in an especially tricky situation by the gear-shift caused by Tel Aviv’s action and its stubborn defence of an indefensible act. Mr Obama had stretched out a hand of peace to the world’s Muslims after he entered the White House, but did not follow this up with sufficient nuts-and-bolts changes in American government policy. Now his administration will be required to do more than merely express the wish to find out the circumstances that led to the tragic event. The fundamental issue is to question Israel’s blockading of Gaza, a tiny strip on the coast with a population of 1.5 million, which Israel has occupied since the 1967 war. In 2007, Israel began a maritime blockade of Gaza after Hamas — widely regarded in the West as a terrorist outfit — handsomely won the 2006 election in that Palestinian territory. The election was widely regarded as fair. British foreign secretary William Hague has called for lifting of the blockade. EU foreign policy chief Catherine Ashton has noted that Gaza’s closure was “unacceptable”. Washington cannot afford to miss the cue here and continue to leave the impression that Tel Aviv enjoys its sanction to impose a blockade on a territory it grabbed as a booty of war. It is plain to see that developments in Gaza and other occupied territories are the key to any positive movement in a peace process between Israel and Palestine, no matter who initiates it. Israel has sought to justify its attack on the peace ships by underlining that its blockade of Gaza is legal. It is unclear where it got this impression, but the assumption is now being questioned with greater vigour than before. India has so much to do with West Asia, but its policies for the region are grounded in uncertainties and opportunism. New Delhi has expressed regret over the loss of lives and Israel’s use of disproportionate force on peace vessels, but it did not raise the basic question about Gaza.

But the situation is far worse than would at first appear, it involves the serious distortion of the official Security Council record by the profligate use by the United States of its veto power. UN decries Israeli flotilla raid

The UN Security Council has condemned acts leading to the deaths of civilians during Monday's Israeli attack on a humanitarian aid convoy that was headed to the Gaza Strip.


In a formal statement adopted after more than 10 hours of closed-door negotiations, the council requested the immediate release of ships and civilians held by Israel and called for an impartial investigation.

Prior to the emergency session, almost all the 15 members of the council deplored the attack that left at least 10 activists on board the Freedom Flotilla dead and dozens injured.
"It is clearer than ever that Israel's restrictions on access to Gaza must be lifted in line with Security Council Resolution 1860," Mark Lyall Grant, the British ambassador, said on Tuesday.

"The current closure is unacceptable and counterproductive," Grant said.
France, Russia and China also called for the blockade to be lifted and for an independent inquiry.
The United States, Israel's traditional ally, did not request specifically that Israel end its blockade on the Gaza Strip. But it hinted that the measure at least should be eased.

Alejandro Wolff, US deputy permanent representative, said that Washington was "deeply disturbed by recent violence and regrets tragic loss of life and injuries".

Meanwhile the EU and Russia have issued a joint condemnation of Israel's use of deadly force in the operation, and urged the opening of crossings in Gaza.

Speaking during a Russia-EU summit, Sergei Lavrov, the Russian foreign minister and Catherine Ashton, the EU foreign policy chief demanded an end to the blockade of Gaza.

Their joint declaration added: "The EU and Russia call for immediate opening of crossings for the flow of humanitarian aid, commercial goods and people to and from Gaza."
The EU's president, Herman Van Rompuy, called for a "durable solution" for the situation in Gaza. "We regret the loss of life, condemn the use of violence and demand an immediate, full and impartial investigation," he said.
Dmitry Medvedev, Russia's president, said that the civilian deaths were "irreparable and aboslutely unjustified."
Meanwhile, Egypt opened its Rafah border crossing with the Gaza Strip letting Palestinians cross until further notice.
Palestinian TV said that Mahmood Abbas, the president, phoned Hosni Mubarak, his Egyptian counter-part, to thank him for "responding to the massacre" by opening the post.

The statements reflected the international community's strong disapprovalof Monday's events in the high seas, when Israeli soldiers stormed the six ships in international waters about 65km off the Gaza coast.
The ships with about 700 pro-Palestinian activists were carrying 10,000 tonnes of humanitarian aid for Gaza, the coastal territory under a crippling Israeli siege.

Israel insisted that its troops had acted in self-defence after being attacked by those onboard.

But Al Jazeera's Jamal Elshayyal, onboard the lead ship Mavi Marmara, said troops opened fire even after passengers had raised a white flag.
Israeli troops have taken the ships to the port of Ashdod after seizing them.

Activists who were injured are being treated in hospitals while 480 others are been detained and subjected to interrogations. Another 48 activists have been deported to their respective countries.
Al Jazeera's Elshayyal is reportedly being held at a detention facility at Tel Aviv's Ben Gurion airport, together with two of his colleagues.
Al Jazeera's Ayman Mohyeldin, reporting from Ashdod, said: "We are still trying to get information in terms of the condition of the passengers...
"An identification and interrogation process has gotten under way, to identify the individuals and then provide them with the option of being deported immediately or sent to prison here," he said.

Thousands marched in the streets of Istanbul, London and Amman in Jordan among other cities on Monday, denouncing the deadly raid on the ships that sought to deliver much-needed supplies to Gazans.

But Israel has remained defiant with Mark Regev, its government spokesman, insisting that "Israel was totally within its rights under international law to intercept the ship and to take it to the port of Ashdod".
He said the people on board the flotilla were not peaceful activists.

"They are part of the IHH, which is a radical Turkish Islamist organisation which has been investigated by Western governments and by the Turkish government itself in the past for their links with terrorist organisations."



Reporting from Jerusalem, Al Jazeera's Jacky Rowland said Israel's reaction has largely been of defiance.



"Many [Israeli citizens] have flocked to the port of Ashdod to basically express their rejection of what they see as the foreign media's negative spin on events.



"...Israeli spin masters have been going into overdrive, doing their best possible to spin this event as though the Israeli commandos were not the ones attacking but rather the attack was perpetrated by people on board," she said.



Israeli 'cover-up'



But Israeli efforts notwithstanding, the country has come in for strong censure.

Murat Mercan, the head of Turkey's foreign relations committee, said that activists on board had links to terrorist organisations was Israel's way of covering up its mistake.
"Any allegation that the members of this ship is attached to al-Qaeda is a big lie because there are Israeli civilians, Israeli authorities, Israeli parliamentarians on board the ship," he told Al Jazeera.
"Does he [Regev] think that those are also attached to al-Qaeda?"
Mark Taylor, an international legal expert, told Al Jazeera that every state, including Israel, has the right to self-defence.
"In this case, we're looking at a humanitarian aid convoy, with prominent people and activists, clearly not a military target in any way whatsoever."
Israeli media reported that many of the dead were Turkish nationals.
Hamas, the Palestinian group which governs the Gaza Strip, said the assault was a "massacre" and called on the international community to intervene.
The Hamas leader in Gaza, Ismail Haniya, urged Arabs and Muslims to show their anger by staging protests outside Israeli embassies across the globe.
